Terms of service

These terms apply when you hire Foundry Nine Digital to build or maintain a website or web app. Plain language is deliberate: if something is unclear, ask us before you sign.
1. What you get
Every project starts from a written quote. The quote lists the base page ($500) and any add-ons ($250 or $500 each) with the total. The total on the quote is the price you pay. We do not bill by the hour and we do not add line items. Anything outside the quote is priced separately, and we agree the price with you before we start it.
2. Payment
We take a 50% deposit to begin work, and the balance is due when we deliver the finished site. We accept the payment methods named on your quote (for example Square, Stripe or check).
3. Your content
You promise that you own, or have permission to use, every text, photo, logo and other item you give us, and that it does not break anyone’s rights or the law. We may ask where an item came from. Unless you tell us not to, we may show the finished site, and a picture of it, in our portfolio.
4. Who owns what
Once you have paid in full, you own the finished website and its files. We keep our own tools, templates and code libraries, and you may use what we built for you without limit.
5. Changes
The quote includes two rounds of changes to the design and wording. More changes are quoted separately.
6. Hosting and support
Hosting, domain names and ongoing support are not included unless the quote says so. If we host your site, we will tell you the price and what is included before you agree.
7. Limits on our responsibility
We build to the quote and fix defects against it (see the refund policy). We are not responsible for lost profits or indirect losses, and our total responsibility for any project is limited to the amount you paid us for it. Nothing here limits responsibility the law does not allow us to limit.
8. Ending a project
Either of us can end a project by telling the other in writing. You pay for the work done up to that point, and the refund policy explains what is returned.
9. Governing law
These terms are governed by the laws of the State of Iowa.
